For me it's always - day rate is hireers responsibility for damages - just can't be any other way, 99% of the time no one knows where your digging until 8am!

On a price and it's my responsibility unless it's specifically excluded and agreed beforehand.

What I said?
Yes... Exactly the same applies to when I subcontract people in to work on my own sites, regardless of trade.

thats the basics of what im trying to achieve dave, as you say we never know where we are digging until last minute, the client could pay us to dig and pour the whole foundation for example, at that point any damage by us is my responsibility, after all im making the profit and taking control. however when client wants to save money and pay us day rate to excavate only, he then takes responsibility of the job on his own shoulders and is liable.

i dont think this is unreasonable. you cant pay a guy 250 for the day then expect him to pay an 800 gas repair bill, when you are the guy making all the profit

If the site is planned and and checked as it should be and there is no record of services then you always dig as if you know there is a service. Any damage should be down to the site owner unles you have a complete moron on the digger.
