Very grey Area Aiden. Only clear part would be running on Red being illegal.

Issues with other areas would be clarity of the rules. Yes a Tractor is for agricultural operations but there are plenty running around for social domestic and pleasure purposes.... somewhere filed away I have a letter from DVLA stating that my classic tractors (that they wanted to reregister into the historic tax class) where still entitled to operated on rebated fuel.

As soon as a lorry/tractor/bus moves over to SDP purposes the rules become very smudged. Certainly in terms of O license, it's not required if running a lorry for SDP, and the same would be on with a tractor, likewise license wise they wouldn't be able to argue that you Need a HGV to use a tractor and trailer for SDP and It would very quickly be thrown out of court.

But the Diesel is the stickler and HMRC as Grah said are the Stazi......

BUT - if a case against any form of SDP went to court there would be a huge amount of public uproar/trouble..... Seen it happen with the Horsey crowd vs DVSA, R.E Tachographs and the case soon got dropped as "it was unviable to prosecute".

All about what would and wouldn't stand in court.

I'm looking at possibly keeping my Merc when I get a new lorry and fitting a plant body for SDP use..... Could even stick a dumper on to bring home or take to charitable events providing it's NOT FOR BUISNESS USE

Current situation is interesting.... I can't say it's not overdue....

LOL . ... been metal shopping today, down me mates and on the main A465 is;
a gang of tree slayers thinning the verges..
with a 13t CAT on street pads, tree shear, kin gert traccy and lowloader trailer for shifting it about ....
plus another gert traccy with a towable beast of a chipper, crane for feeding it
and two other traccies with V. large dump/silage type trailers with lids on being fed wood chip ....
all running back and fore on a main trunk road.

Now I'll bet my left nut the two hauling the chip are on Ag and red ... I know who they are

the chipper set up .. I don't know but doubt it's any different.

As for the CAT etc. ... no reg plate on that for starters, so bet it's not, or taxed ... or road risk insured ... it's sat on the highway and traveling about on it.
The CAT's transport? .... well no idea TBH ... but'd be a fairly safe guess it's far from compliant ... lad driving the traccy looked about 18. ...... Just

Now ...... to me that is highway maintenance .... deffo not forestry ..... I wonder if Highways England/Welsh office have even bothered to ask if they all have the correct licenses / ins / taxation class, etc. on all this kit ?

A well gen.ed plod and his mate from DVSA could well get themselves several 'full houses' on that 1/4 mile stretch, without breaking sweat

It's not forestry. Forestry is the growing and cutting of trees to produce timber.

Druid is correct IMHO, it's highway maintenance.

So it would also fall into the category of cutting roadside verges then

To qualify as an excepted vehicle, the tractor must be an agricultural tractor designed and constructed primarily for use otherwise than on roads. It must not be used on public roads except for:

(a) purposes relating to agriculture, horticulture or forestry

(b) cutting verges bordering public roads

(c) cutting hedges or trees bordering public roads or bordering verges which border public roads
